The recent update of Regulatory Standard No. 01 (NR-01), through MTE Ordinance No. 1,419 of August 28, 2024, brought important changes that directly impact companies in terms of Occupational Risk Management (ORM). One of the main changes is the obligation to include the management of psychosocial risks in the workplace, in the preparation and implementation of the Risk Management Program (PGR).

With the changes, companies must assess and control occupational risks, covering physical, chemical, biological, ergonomic and now psychosocial agents. As a result, factors such as occupational stress, harassment and burnout are now formally considered in occupational health and safety management. The standard therefore requires companies to adopt a more comprehensive approach to promoting a safe and healthy working environment.

To meet this requirement, psychosocial risk management requires organizations to assess their working conditions and adopt measures such as:

  • Creating active listening channels for employees;
  • Implementing emotional support programs;
  • Leadership training to recognize and mitigate risks; and
  • Implementing internal policies that promote an inclusive and respectful organizational culture.

What does your company need to do to comply with NR-01?

To ensure compliance with the new wording of NR-01, companies need to adopt specific measures, such as:

  1. Updating internal documents: including the issue of preventing psychosocial risks in the company’s Internal Regulations and Code of Ethics.
  2. Creating a specific policy: with the aim of preventing any kind of psychosocial risk in the workplace.
  3. Adaptation of communication channels: implementation of internal procedures and effective reporting channels to report any form of violence and/or harassment in the workplace.
  4. CIPA training: training the Internal Accident Prevention Commission (CIPA) in the new procedures required by the standard.
  5. Promoting organizational well-being: developing and implementing programs that encourage quality of life, such as sports, gymnastics and other initiatives aimed at reducing stress.
  6. Strengthening a positive organizational culture: adopting measures to promote an environment of mutual respect, recognition of achievements and employee well-being.
  7. Inclusion of psychological support: development of internal policies that include psychological support for employees.

Fines for non-compliance and non-adaptation

Companies have until May 25, 2025 to comply with the new requirements.

If the company fails to implement a Risk Management Program (RMP) or neglects to manage psychosocial risks, it could face fines, labor lawsuits and difficulties in renewing safety certifications. In addition, they may be subject to public civil actions, conduct adjustment agreements (TAC) and an increase in the rate of Occupational Accident Insurance (SAT) and the Accident Prevention Factor (FAP).

It is therefore essential that companies adopt effective preventive management of occupational risks, ensuring compliance with NR-01, especially with regard to psychosocial factors.
